Litigation

Litigation is the term used to describe the process where one party (“Plaintiff”) brings a claim (“proceedings”) against another party or parties (“Defendants”) which is heard in Court and decided upon by a Judge.

Holohan Law are experienced in all aspects of litigation in the Court System. We advise clients on the viability or likelihood of success of such claims and process them as efficiently as possible and minimise the stress involved. In consultation with our clients, we apply our expertise and knowledge of the law to develop a strategy for tackling a dispute in the most practical manner and in an effort to resolve the issue to the satisfaction of the client or to achieve their desired goal.

Our litigation and dispute resolution solicitors act for a broad spectrum of clients, ranging from individual personal injury claims to smes, universities and major corporations. We are often the first port of call for any parties who find themselves in a dispute and wish to seek advice on how to proceed on the matter.

We represent our clients at all levels, from the District Court, Circuit Court and High Court to the Supreme Court. We also have considerable experience in dealing with disputes in a Commercial Court, which has been in existence since 2004 and has earned a reputation for being practical economical and efficient way for dealing with high value claims.

The court where one initiates an action depends on the type of action or the financial jurisdiction of each court. The District Court is restricted to hearing cases where generally the damages or compensation sought does not exceed €15,000

The Circuit Court has jurisdiction to hear and decide cases in actions in contract and tort where the claim does not exceed €75, 00.00 (other than personal injury claims). For claims involving personal injury the Circuit Court can hear claims where the damages sought does not exceed €60,000.00.

The High Court is the appropriate court to hear cases involving claims for damages in excess of the above amounts.

When necessary, the assistance of Barristers is availed of and they are usually involved in Circuit Court, High Court and Supreme Court cases.
